(Compensation and Assistance due to Cancellation of Flight or Change
in Terms), 5772-2012. This law, which was published on May 29,
2012 and went into effect on August 16, 2012, makes it mandatory to
give benefits to a passenger whose flight was cancelled or delayed;
it also requires travel agents to help passengers to exercise their
rights. The law provides that the court may
order an airline, which knowingly acted contrary to the statutory
provisions, to pay damages of up to NIS 10,000. The period of
prescription for exercising rights under the new law is four years

Israeli lessee, and that the Israeli company was obligated to
disclose to the plaintiffs that there was no spare tire in the car

Judgment of the Magistrates Court in the Krayot of March 1, 2006
(before Hon. Justice Ayelet Dagan)
concerning the duty of a travel agent and supplier of vacation
packages to special-needs passengers (handicapped in wheelchairs).
It was held that in the specific case of a passenger with
mobility difficulties, the supplier has a "minimum duty of care to
verify (even by phone) that the hotel is geared to accommodate the
plaintiff with her specific handicap and that all the facilities
needed function. This duty is easy to carry
out and no unreasonable costs are involved.
This duty may stem from various legal sources, including the duty of
care in a tort of negligence, a contractual duty to exercise rights
